摘要

近些年来，在有关于计算机软件侵权纠纷案件中，计算机软件专利侵权案件所占的比重是越来越大。专利侵权案件中判定案件是否构成侵权的前提和基础就是要确定计算机软件专利权的保护范围。但是由于计算机软件专利自身的特点与撰写的特殊要求，计算机软件专利权保护范围的确定也有其特殊的地方。因此计算机软件专利的侵权判定也有其特殊性。计算机软件专利的侵权判定不仅仅是一个法律层面上的问题，更是一个技术层面上的问题。本文以计算机软件专利的侵权判定为题，就是希望通过对这方面的理论研究，加强自己对计算机软件发明专利的认识，为以后的工作学习奠定基础，也期望能够为计算机软件专利侵权案件的司法实践有所帮助。

本文总共分为六章，第一章是绪论，主要概述了选题的背景、意义、研究综述以及论文的研究思路。第二章主要是对计算机软件专利和专利侵权判定的概述，主要论述了计算机软件发明专利和专利侵权判定的基本含义与一般性规定，着重概述了欧美两国对计算机软件发明专利的态度与确定计算机软件发明专利权保护范围对专利侵权判定的重要性。第三章到第六章主要阐述了专利侵权判定中的四个基本原则，即全面覆盖原则、等同原则、禁止反悔原则、公知技术抗辩原则在计算机软件专利的侵权判定中的适用。每章都分为两个小节，第一小节都是从每个基本原则的基本含义与一般适用规定进行展开论述，明确每个原则在一般领域的专利侵权判定中的适用规则。第二小节主要是论述了每个基本原则在计算机软件发明专利的侵权判定中的适用规则，通过说明计算机软件发明专利权与一般领域的发明专利相比有之特殊性来突出每个基本原则在计算机软件发明专利侵权判定中适用的特殊规定。关键字：计算机软件专利权保护范围；全面覆盖原则；等同原则；禁止反悔原则；公知技术抗辩原则

Abstract

In recent years, it takes more and more proportions in the infringement of computer software for the infringement case of the computer software patent. The premise and basis of that whether it constitutes infringement is to ensure the scope of protection of the computer software patent. Due to the specificity of the computer software patent itself and the special demand of the writing, the scope of protection of the computer software patent has some specificity at the extent. Ensuring the scope of protection of the computer software patent is not only related to the law, but also related to some technology. In this paper, we focus on the judge of the scope of protection, so that, we can enhance the cognition of the patent for invention of computer software for our later works and studies, we hope that it is helpful for the practice in infringement case of the computer software.
