End User License Agreement for E-furniture APP

Important!

Before installing and using the software, any additional programs that may be provided or materials that form part of it, and/or electronic or online format documents (collectively referred to as "software"), please carefully read these Terms of Use (hereinafter referred to as "E-furniture" as E-furniture APP).

This E-furniture does not provide for the rights and obligations of corresponding services, such as using APPps downloaded from 360, Google Play, or APPp Store servers that are not part of the agreement, especially without involving guarantees, responsibilities, maintenance, and services.

If you install E-furniture APP as an administrator or as another employee of an authorized installation company, and if you subsequently provide E-furniture APP to users, you also agree to E-furniture and promise to use E-furniture APP only as described in this article. However, if you refuse the terms of this E-furniture, you have no right to download, install, and use the E-furniture APP in any way.

1. Summary

E-furniture APP is provided by Shenzhen Yikongdi Intelligent Home Technology Co., Ltd. for your use (hereinafter referred to as the "User"). Shenzhen Yikongdi Intelligent Home Technology Co., Ltd. (hereinafter referred to as the "Licensor"), in accordance with the terms of this E-furniture. All rights not explicitly granted by this E-furniture are still reserved.

2. APPplication purpose

The E-furniture APP aims to facilitate data exchange and communication with the licensor's products, enabling the operation and remote control of the licensor's products, such as changing the position settings of the head, back, legs, and/or feet through the E-furniture APP. Other features of the licensor's product, as long as they are included in the licensor's product as a device, can be controlled through E-furniture APP. Any other use of E-furniture APPP that is different from the above does not meet the expected use and is not allowed.

3. License

3.1 The licensor grants E-furniture APP users a non exclusive right to install and use E-furniture APP on mobile smartphones supported by E-furniture APP, where the user is its owner or has the right to dispose of the service in accordance with the terms of use, such as 360 Mobile Assistant, Google Play, or APPp Store, which do not violate.

3.2 Users have no right to transfer or sell their rights and obligations granted by the license to third parties or grant sub licenses.

3.3 In addition, users shall not distribute E-furniture APP for the purpose of providing to third parties (unless the service (such as 360, Google Play, or APPp Store) is permitted under the terms of use) for lending, leasing, or any other allocation.

3.4 If the user sells, lends, leases, or leases the licensor's products related to E-furniture APP to a third party, the obligations of Sections 3.2 and 3.3 shall not APPply.

3.5 In addition, users shall not be allowed to decompile, disassemble, translate, integrate, adopt, or attempt to convert software in modified form, or create exported versions of E-furniture APP that are neither complete nor partial.

3.6 The end user shall not copy the E-furniture APP and the device where the backup copy is saved is the user's property, or he has the right to dispose of the device legally. Users have an obligation to protect unauthorized third parties from accessing such copies forever.

3.7 The licensor shall take legal action against any attempt to violate the above obligations and/or any such violation, and reserves the right to claim damages in such circumstances.

3.8 This End User License Agreement also APPplies to potential updates provided by the licensor as an additional or replacement offer, as long as such updates are not subject to the independent license agreement.

3.9 The licensor reserves the right to modify the above terms.

4. Technical prerequisites

4.1 E-furniture APP is developed for use on smartphones and provided by servers for download, such as 360 Mobile Assistant, Google Play, or APPp Store. In addition, E-furniture APP requires an APPpropriate operating system version. Regarding Android, an operating system version 4.3 or higher is suitable. Although the licensor attempted to adjust the E-furniture APP to change the operating system version and make it available on such terminal devices, users do not have the right to request such updates.

4.2 Users are personally responsible for checking and protecting whether the mobile terminal devices they intend to install are suitable under the aforementioned technical conditions.

4.3 The licensor reserves the right to adjust the technical prerequisites at any time.

5. User's security obligations regarding possible software conflicts:

Before the user installs E-furniture APP, due to their security responsibility, check if this installation may cause conflicts with any software already installed. In addition, users should ensure that they are provided with backup copies of all their data. When using E-furniture APP, all other reasonable protective measures should be taken to avoid any possible software errors.

6. Warranty

6.1 The licensor guarantees that the E-furniture APP developed by the licensor is free of charge when downloaded from platforms, data carriers, or data transfers (such as 360 Mobile Assistant, Google Play, or APPp Store). In addition, the licensor guarantees that the E-furniture APP in all key points will respond according to user documentation, provided that it is executable on the terminal device, has not been altered, and has not installed incompatible additional software from external sources on the terminal device, or if there are no other circumstances within the user's scope that would impair operability. Users should immediately check the E-furniture APP after installation and notify any defects by email or letter to the contact data provided in item 9.

6.2 If the E-furniture APP proves a defect, the licensor shall have the opportunity to correct the defect by repairing or compensating the delivery for subsequent execution based on the nature of the defect and other circumstances.

6.3 The licensor shall not be liable for any defects or interferences caused by unauthorized modifications to the E-furniture APP, improper use of software or hardware, or improper handling of accessories by users or third parties.

Claims for damages caused by E-furniture APP defects can only be made in accordance with the terms of Project 7.

7. Responsibility

7.1 The liability of the licensor, its legal representatives, and agents for property and asset losses caused by negligence of duty and infringement is limited to intentional acts and gross negligence. In the event of a breach of significant contractual obligations (so-called "basic obligations"), the licensor also bears simple negligence liability. In any case, liability is limited to foreseeable typical contractual damages.

7.2 The licensee undertakes to comply with the normal use of the software and APPply the software separately, so that the use of the software will not cause harm to the device and life.

7.3 To avoid data loss, the licensee shall use the backup copy function, but shall not conflict with any other APPplicable usage plan.

7.4 The licensor shall not be liable or responsible for any losses caused by the failure to use data backups before installing the software or any property or personnel damage resulting from improper use.

8. There is no confirmation of export restrictions

The user confirms and ensures that they do not reside in a country subject to government sanctions, are classified as a "support for terrorism" country by the government, or are listed on the government's export ban list or restrictions.

10. APPproval of data processing

The technical data and information agreed upon by the user, such as the collection of technical information for terminal devices, operating systems, and user software, for the purpose of updating, supporting services, and other service industry regulations, shall be stored and used with a license (as long as necessary) connected to E-furniture APP. The licensor has the right to retain and use this data in a non personal or non personal form to improve its products.

11. Deadline, Termination

This E-furniture shall remain valid as long as it is not cancelled by the parties to this agreement. If the user does not comply with the conditions of this End User License Agreement, their rights will automatically terminate without further notice from the licensor. After terminating this E-furniture, the user is obligated to immediately cease using the APPplication and destroy all copies of their E-furniture APP or partial copies of the E-furniture APP. After uninstalling the E-furniture APP software or deleting all data of E-furniture APP, or deleting all data or backup copies, this E-furniture will automatically end.

12. Protecting Copyright

12.1 E-furniture APP is protected by copyright.

12.2 The licensor shall not assume any guarantee of copyright protection for the licensed E-furniture APP or any part thereof.

13. Location and APPplicable Law

The APPplication of the laws of the People's Republic of China does not include its principles of international private law. Excluding the APPplication of the Sales Convention.

E-furniture APP shall have jurisdiction over all disputes arising from this E-furniture.

14. Separability clause

If any provision of this agreement becomes invalid or if the agreement contains any loopholes, the validity of the other provisions shall not be affected. Instead of invalid provisions, effective provisions should be considered as agreed terms that are as close as possible economically to the intentions of all parties involved; This also APPplies to any vulnerability situation.

15. Revision of the Agreement

Any modifications to this agreement shall be made in writing to make it effective, and there shall be no supplementary agreements to this agreement.
