如何进行德国专利申请？

一、德国发明和实用新型专利的申请方式：巴黎公约、专利合作条约(PCT)渠道。

1.《巴黎公约》渠道：

在中国提出申请后，在优先权日起12个月前向德国知识产权局提出专利申请。可以享有优先权待遇，并需要提交优先权证明文件。

德国专利申请所需的文件和信息：

(1)德国专利申请文件：包括说明书、权利要求书、说明书附图、摘要、摘要附图

(2)德国专利申请信息：申请人、发明人的中英文姓名、地址、邮政编码、申请国家、联系人等。

(3)如果要求优先权，还需要提交在先申请的优先权文件的副本

2.专利合作条约(PCT)渠道：(通过欧洲专利局或直接向德国专利局提出申请)

根据专利合作条约的规定，申请人可以通过PCT提出国际申请，向世界上几乎所有国家提交专利申请，即在中国在先申请的申请日起12个月内向中国国家知识产权局提出PCT国际申请，在优先日起31个月内向德国知识产权局提出进入申请或向欧洲专利局提出申请，然后向德国专利局登记。

德国专利申请所需文件：

(1)提交的原始申请文件和PCT申请书或已公开的PCT申请册

(2)国际检索报告

(3)根据专利合作条约第19条修改的权利要求(如果有的话)

(4)根据专利合作条约第34条修订的申请文件(如果有的话)、国际初审报告。

二、德国申请外观设计专利的方式包括巴黎公约渠道和直接向德国提出申请。

DPMA对外观设计实行形式审查制度，一项外观设计的公布或使用该外观设计产品的传播，不违反社会秩序或者社会良俗的，应当予以登记。登记后两个月左右，以公报的形式公开。从申请至公开一般为四个月，保护期为二十年。

巴黎公约渠道：在中国就同一主题向德国工业产权局提出申请后，自在先专利申请日(即优先权日)起计的前六个月内，可以给予优先权待遇，需提交优先权证明文件。

需要编制的材料和应提供的信息：

(1)德国专利申请信息：申请人、发明人的中英文姓名、地址、邮政编码、申请国家、联系人等。

(2)外观设计图片或照片：申请人应提交立体视图和六面视图(即主视图、后视图、左视图、右视图、俯视图和仰视图)，六面视图的大小比必须相同。如有必要，可以提交参考视图。

(3)外观设计简介

(4)如果要求优先权，还需要在先申请的优先权文件的副本。

1. ' Paris Convention ' channel :

After the application was filed in China, a patent application was filed with the German Intellectual Property Office 12 months before the priority date. You can enjoy priority treatment, and need to submit a priority certificate.

( 1 ) German patent application documents : including description, claim, prospectus, summary and prospectus

( 2 ) German patent application information : applicant, inventor ' s Chinese and English name, address, postal code, applicant country, contact, etc.

2. Patent Cooperation Treaty ( PCT ) channel : ( through the European Patent Office or directly to the German Patent Office )

According to the provisions of the patent cooperation treaty, the applicant can make an international application through PCT, and submit patent applications to almost all countries in the world. That is, within 12 months of the application date of China ' s first application, the applicant can make an international application for PCT to the National Intellectual Property Office of China, and within 31 months of the priority date, the applicant can submit an entry application to the German Intellectual Property Office or an application to the European Patent Office, and then register with the German Patent Office.

 

German patent application documents :

( 1 ) Original application documents and PCT applications submitted or published PCT application books

( 2 ) International retrieval report

( 3 ) The right requirements modified according to Article 19 of the Patent Cooperation Treaty ( if any )

( 4 ) Application documents ( if any ), international preliminary reports, as amended under article 34 of the Patent Cooperation Treaty.

 

2.The ways of applying for design patent in Germany include Paris Convention channel and direct application to Germany.

DPMA implements a formal review system for appearance design. If the publication or use of the appearance design product is not in violation of social order or social customs, it should be registered. Approximately two months after registration, it is made public in the form of communiqué. It is generally four months from application to disclosure, and the protection period is twenty years.

Paris Convention channel : After China filed an application to the German Industrial Property Office on the same subject, priority treatment can be given within the first six months from the date of the application for a prior patent ( i.e. the priority day ), and the priority certificate should be submitted.

 

Materials to be prepared and information to be provided :

( 1 ) German patent application information : applicant, inventor ' s Chinese and English name, address, postal code, applicant country, contact, etc.

( 2 ) Design pictures or photos : Applicants should submit stereo view and six-sided view ( that is, the main view, the rear view, the left view, the right view, the overlooking view and the elevation view ), and the size ratio of the six-sided view must be the same. If necessary, you can submit a reference view.

( 3 ) Introduction of appearance design

( 4 ) If priority is requested, a copy of the priority document requested in advance is also required.
