　德国商标注册保护对象

　　文字，字母，数位，图形，音响，立体等。商标不经注册不能受到保护。

　　德国商标注册申请资格

　　根据德国商标法，商标注册申请人可以是任何国家或地区的企业、事业单位、社会团体、工商业者、或自然人。

　　商标图样

　　申请时必须提供希望受到保护的图样。

　　文字商标中的字体如果不是专利局通用的，如图形化设计的商标，或组合商标和指定顏色的商标，必须提供四份图样。如果需要顏色保护，在申请中必须指明顏色。注册立体商标需要提交四份相同的平面图样。最多可能需要此商标六个不同角度的视图(每个各四份)。

　　申请音响商标注册

　　音响商标能受到保护的程度和它总体的音响效果有关。不管何种商标申请，都有可能需要添加说明。

　　商品和服务

　　商品和服务必须以分类顺序填写;建议使用尼斯分类字母排序表中的名称。如不行，也可以用行业中通用的名称。必须使用德文。如果需要商品或服务专案的解释，德国专利局会通知申请人，要求解释。申请一旦提交，不能再增加商品或服务专案，但随时可以减少。申请人可以指定一个优先类别。如果费用不足，此类将被优先考虑。

　　代理人

　　在德国境内有住所或营业场所的，在原则上可以去专利局或专利法院直接申请注册。如果没有，任何人(即使是有德国国籍的人)都必须通过专利代理人或律师代理。需要签署委託书，无需公证。

　　德国商标注册申请的办理程式及时间

　　申请人向德国申请商标注册，委託本公司代理到德国的商标主管机关申请注册，在我们收到申请文件后，我们会及时转交有关部门。申请人一般在6周之内收到答復档、受理日和受理号。如商标申请在法定的必经程式非常顺利的情况，一般约需6-9个月。如果需要加急办理(3-6个月)，则另需缴纳加急费用。但若该商标申请在审查程式中出现商标局核发补正通知、审查意见的情况，或者进入特别程式，即出现商标申请被初步审定公告后遭他人异议或商标申请被驳回后申请復审的情况，商标申请最终获准注册则需更长一些时间。

　　获得商标注册证后，德国商标局向社会公开其商标，如果在3个月内没有遭他人异议，此商标的所有权就属於贵公司，注册商标有效期為十年，自核准注册之日起计算。有效期满前可以申请续展注册，每次续展注册的有效期為十年。如果在3个月内遭他人异议,商标局会根据实际情况进行裁决。

　　请求加速审查

　　指希望就申请要求和驳回绝对理由作出迅速决定，需额外支付附加费400美元。

　　德国商标申请注册的优先权

　　如果一商标在巴黎公约一成员国内已经完全相同地注册(图样、商品)，那麼除了特定的情况，可以获得注册。

　　德国商标注册的异议程序

　　商标注册公告后，在先权利人可以在三个月内提出异议。异议一式两份作出。如果异议成立，注册将被撤销。如果这三个月里没有异议，商标就被正式注册了，只有登出撤销程式才能撤销商标权。

　　德国商标的保护期

　　保护期十年，从申请日算起，至十年后申请日所在月的最后一日為止。以后，每次续展十年。续展必须在保护期最后一日前作出，如果在这一天还没有缴纳费用，专利局将通知注册人其商标将被撤销。在此通知送达后六个月内，注册人仍然可以提出续展，但必须多交一笔费用。

　　注销德国商标

　　商标权所有人可以在任何时候全部或部分(指部分商品或服务)放弃注册商标。在申请过程中，可以随时撤回，或减少商品或服务专案。

　　注册德国商标所需材料申请人提供下列材料：

　　1)企业名称、地址(中英文);

　　2)商品/服务的国际分类及指定使用商品/服务清单等资讯;

　　3)营业执照影本;

　　4)商标图样5份，要求清晰、纸张品质好。如是彩色商标，需递交1份黑白稿，5份彩稿;规格不得小於5cm×5cm，最大不超过 10cm×20cm;

5)授权委託书(由本公司提供,但须由申请人签字)。

German trademark registration application qualification

Under German trademark law, the applicant for trademark registration may be an enterprise, institution, social organization, businessman or natural person in any country or region.

 

Trademark pattern

A pattern wishing to be protected must be provided upon application.

 

If the font in the text trademark is not commonly used by the Patent Office, such as a graphic design trademark, or a combination trademark and a specified color trademark, four drawings must be provided. If color protection is needed, color must be specified in the application. Registered three-dimensional trademarks need to submit four identical plane drawings. Most likely need six different angles of view of this trademark ( each four ).

The degree to which the sound trademark can be protected is related to its overall sound effect. Any trademark application may require additional instructions.

 

Goods and services

Commodities and services must be completed in the classification order ; it is recommended to use the names in the alphabetical list of Niss classification. If not, the common name in the industry can also be used. German must be used. If the need for interpretation of the goods or services project, the German Patent Office will notify the applicant for interpretation. Once the application is submitted, the goods or services can not be increased, but can be reduced at any time. An applicant may specify a priority category. If the cost is insufficient, such will be given priority.

Agent

Where there is a place of residence or business in Germany, it may in principle apply directly to the Patent Office or the Patent Court for registration. If not, anyone ( even those with German nationality ) must be represented by a patent agent or a lawyer. Need to sign the trust, no notarization.

 

Procedure and time of application for German trademark registration

When the applicant applies for trademark registration in Germany, the company is entrusted to apply for registration by the trademark authority in Germany. After receiving the application documents, we will transmit them to the relevant departments in time. Applicants generally receive the response file, acceptance date and acceptance number within 6 weeks. It usually takes about 6 to 9 months if the trademark application is very smooth in the statutory required procedure. Additional costs are required if an acceleration is required ( 3-6 months ). However, if the trademark application is subject to the issuance of the notice of correction and the review opinion by the Trademark Office in the review process, or enters the special procedure, that is, if the trademark application is subject to objection by others after the preliminary approval announcement or the application for review after the rejection of the trademark application, it will take longer for the trademark application to be finally approved for registration.

 

After obtaining the trademark registration certificate, the German Trademark Office opens its trademark to the community. If it is not dissented by others within three months, the ownership of this trademark belongs to your company. The validity of the registered trademark is ten years, and it is calculated from the date of approval and registration. Renewal registration can be applied before the expiration of the valid period, and the validity period of each renewal registration is ten years. If it is challenged by others within 3 months, the Trademark Office will decide according to the actual situation.

It means that if you want to make a quick decision on the application requirements and the absolute reasons for rejection, you need to pay an additional $ 400.

 

Priority of application for registration of German trademarks

If a trademark has been registered exactly the same in a member State of the Paris Convention ( drawings, commodities ), it may be registered except in a particular case.

 

Objection Procedure for German Trademark Registration

After the trademark registration announcement, the prior obligee may raise an objection within three months. The objection is made in two copies. If the objection is established, the registration will be revoked. If there is no objection in these three months, the trademark will be officially registered, and the trademark right will be revoked only if the revocation procedure is published.

 

Protection period of German trademark

The protection period is ten years, from the application date to the last day of the month after ten years. After that, it will continue for ten years each time. The renewal must be made before the last day of the protection period. If the fee has not been paid on this day, the Patent Office will notify the registered person that his trademark will be revoked. Within six months after the notice is served, the registrant can still propose a renewal, but it must pay an extra fee.

 

Cancellation of German trademark

The owner of the trademark right can give up the registered trademark in whole or in part ( referring to some goods or services ) at any time. In the application process, you can withdraw at any time, or reduce the goods or services project.

The applicant for registration of German trademarks shall provide the following materials :

1 ) Enterprise name, address ( Chinese and English ) ;

2 ) Information on the international classification of goods / services and the list of designated uses of goods / services ;

3 ) Photocopy of business license ;

4 ) 5 trademark drawings with clear requirements and good paper quality. If the color trademark, need to submit 1 black and white manuscript, 5 color manuscript ; specification shall not be less than 5cm × 5cm, maximum not more than 10cm × 20cm ;

5 ) Letter of authorization ( provided by the company, but signed by the applicant ).
