如何申请注册商标

一、 需提交的申请注册商标文件

1、 商标标样实例，包括指定的产品或服务；

2、 注册商标图样；（26.2×17CM）

3、 申请注册商标费用；

二、 商标注册申请程序

接到申请注册商标后，专利局先给申请发一个文号并确定申请日期（专利局收到申请的日期），然后马上向申请人或代理人寄出受理通知书。这以后，专利局将不再就收到书件寄出通知书。

在确定文号和付费的类虽后，将对是否符合申请注册的正式要求作出审查。

如果不符合要求，将通知申请人补正。如果补正在规定期限内作出，将继续申请程序，否则，将驳回申请。如果申请存在以下缺陷，将以补正后的日期为申请日期：缺少申请人身份的信息；没有商标图样；没有指定商品或服务项目。如果没有驳回的绝对理由，商标就能获得注册。如果有绝对理由，申请人将接到通知书，并有机会在专利局规定的时间内就此陈述意见。

考虑到申请人意见后，如果专利局认为仍有必要维持驳回。将由更高一级的审查员来决定能否注册。如果注册被最终驳回，申请人可以首先向OBJECTION EXAMINER提出反对，反对无效，可以向联邦专利法院上诉。提出反对，不用另外收费。

如果专利局没有在六个月内就反对作出答复，申请人可以提出裁定请求，如果请求在两个后还没有作出，申请人可以直接提出上诉。如果申请资料符合规范，不存在绝对理由，商标将被注册和公告。

必须注意到的是，注册后，商标获得的只是临时性权利，还有可能遭到基于在先权利的异议。

商标注册异议

商标注册公告后，在先权利人可以在三个月内提出异议。异议一式两份作出。如果异议成立，注册将被撤销。如果这三个月里没有异议，商标就被正式注册了，只有注销撤销程序才能撤销商标权。

商标注册保护

保护期十年，从申请日算起，至十年后申请日所在月的最后一日为止。以后，每次续展十年。续展必须在保护期最后一日前作出，如果在这一天还没有缴纳费用，专利局将通知注册人其商标将被撤销。在此通知送达后六个月内，注册人仍然可以提出续展，但必须多交一笔费用。

2. Trademark registration procedures

After receiving the application for a registered trademark, the Patent Office first sends a number to the application and determines the application date ( the date of receipt of the application by the Patent Office ), and then immediately sends the acceptance notice to the applicant or agent. After that, the Patent Office will no longer receive the written notice.

After determining the number and payment category, the formal requirements for registration will be reviewed.

If it does not meet the requirements, the applicant will be notified to correct. If the supplement is made within the prescribed time limit, the application procedure will continue, otherwise, the application will be rejected. If the application has the following defects, the date after correction will be the application date : lack of information on the applicant 's identity ; no trademark pattern ; no goods or services are specified. If there is no absolute reason for rejection, the trademark can be registered. If there are absolute reasons, the applicant will receive a notice and have the opportunity to make comments on it within the time stipulated by the Patent Office.

Taking into account the views of the applicant, if the Patent Office believes that it is still necessary to maintain the rejection. It will be decided by a higher level of inspectors to register. If the registration is finally rejected, the applicant can first object to OBJECTION EXAMINER. The objection is invalid and can appeal to the Federal Patent Court. Objection, no additional charge.

If the Patent Office does not respond to the objection within six months, the applicant can make a ruling request. If the request is not made after two, the applicant can directly appeal. If the application data conform to the specification, there is no absolute reason, the trademark will be registered and announced.

It should be noted that after registration, the trademark only obtains temporary rights, and may be subject to objections based on prior rights.

 

Trademark registration objection

After the trademark registration announcement, the prior obligee can object within three months. The objection is made in two copies. If the objection is established, the registration will be revoked. If there is no objection in these three months, the trademark will be officially registered. Only the cancellation procedure can cancel the trademark right.

 

Trademark registration protection

The protection period is ten years, from the application date to the last day of the month after ten years. After that, it will continue for ten years each time. The renewal must be made before the last day of the protection period. If the fee has not been paid on this day, the Patent Office will notify the registered person that his trademark will be revoked. Within six months after the notice is served, the registrant can still propose a renewal, but it must pay an extra fee.
