3、简述专利的特点

答:专利权有一定的期限。各国专利法对专利权的有效保护期限都有自己的规定,计算保护期限的起始时间也各不相同。我国《专利法》规定:“发明专利权的期限为二十年,实用新型专利权和外观设计专利权的期限为十年,均自申请日起计算。”

4、什么是职务发明与非职务发明

答:凡执行本单位任务或者主要利用本单位的物质条件所完成的发明创造,即属于职务发明。退职、退休或者调动工作一年内做出的与其原单位的本职工作或分配的任务有关的发明创造,也属于职务发明。

与职务发明条件无关的发明创造,属于非职务发明。

5、什么是优先权

答:优先权(Priority)是保护工业产权巴黎公约规定的一种优惠权利。

指的是任何缔约国的申请人,向一个缔约国提出专利申请后,在一定的期限内(发

明和实用新型为12个月,外观设计为6个月),若再向其他缔约国就同一发明提出

专利申请,可享受优惠权利,即将第一次提出申请的日期视为后来在其他缔约国

6、什么是专利族、同族专利、基本专利?

答:专利族: 同一项发明创造在多个国家申请专利而产生的一组内容相同或基本相同的文件出版物,称一个专利族(Patent Family)。

同族专利:同一专利族中的每件专利文献被称作专利族成员(Patent Family Members),每个专利族成员就互为同族专利。

基本专利:在每一专利族中,向第一国申请专利的文件出版物为基本专利。

7、区别发明人(设计人)、申请人、专利权人、代理人。

Atechnique for providing routing of various multimedia events throughout thecourse of a multimedia presentation using a computer with a storage and adisplay. A variety of multimedia objects are defined in the storage and groupedin logical relationships to enable multimedia presentations. A display is usedto create the presentations interactively by positioning objects representativeof the multimedia events and joining them with geometric figures, such as linesegments. Each object can then be directly manipulated via a mouse or otherpointing device to position a multimedia object to a particular position, oradjust the playback rate of a multimedia object.

Claims

Having thus described our invention,what we claim as new, and desire to secure by Letters Patent is:

 

1. A user-configurablemultimedia information processing system for use on a computer having adisplay, the system comprising: a media source that generates a multimediainformation stream composed of a time sequence of multimedia informationpackets and that comprises a mechanism that generates an icon on the displayrepresenting the media source, an output port having a write method thatsequentially writes each multimedia information packet to a first buffer and aconnect method that connects the output port to an input port specified by auser; a media processing component that sequentially processes multimediainformation packets comprising a mechanism that generates an icon on thedisplay representing the media processing component, a processing task thatprocesses multimedia information packets, an input port with a read method thatreads multimedia information packets into the processing task and an outputport with a write method that receives processed multimedia information packetsfrom the processing task and sequentially writes the processed multimediainformation packets to a second buffer and a connect method that connects theoutput port to an input port specified by a user; a media presentationcomponent that sequentially presents multimedia information packets to a userand comprises a mechanism that generates an icon on the display representingthe media presentation component, an input port with a read method that readsmultimedia information packets from a buffer for presentation to the user; anda mechanism that allows a user to manipulate icons on the display to call themedia source connect method and the processing component connect method toselectively connect the media source, the processing component and the mediapresentation component to form a multimedia information processing system.

 

2. The system of claim 1 whereineach input port comprises a data type and each output port comprises a datatype and wherein each connect method comprises a type negotiator that examinesthe data types of an input port and an output port in order to determinewhether that input port and that output port can be connected.

 

3. The system of claim 1 whereinthe media presentation component is connected to the media source and the mediapresentation input port reads multimedia information packets from the firstbuffer for presentation to the user.

 

4. The system of claim 1 whereinthe media source is connected to the media processing component and that mediapresentation component is connected to the media processing component and themedia presentation input port reads multimedia information packets from thesecond buffer for presentation to the user.

An enhanced telephone emulation computersystem including a minidialer program for controlling a computer to addtelephony functions which can be invoked from whatever active program iscurrently controlling the computer. The minidialer program controls thecomputer to alter its processing depending upon the context existing at thetime when a mouse click or hot key combination event is detected indicating theuser wishes to invoke a telephony function. The minidialer program determineswhether the user has highlighted any text or numbers in the active window ofthe application currently controlling the computer and whether the highlightedmaterial is a name or a phone number, and if a name, whether the name is storedwith a phone number in a phone book or file maintained on the computer.Processing and telephony menu options displayed as available also depend uponwhether the user is or is not on the phone at the time the mouse click or hotkey event occurs. In some embodiments, if the user has highlighted a URL, abrowser will be launched and the web page corresponding to the URL will beopened.

What is claimed is:

 

1. An apparatus, comprising: a computercontrolled by an operating system program and having a telephone functionlibrary of programs that control the computer to implement conventionaltelephone functions, said operating system controlling said computer toimplement a telephony application programmatic interface (TAPI), comprising aplurality of function calls that are invoked to implement various telephonefunctions, said operating system being configured to run a dialer program andat least one application program that differs from the dialer program, whereinthe at least one application program does not comprise a telephone applicationprogram or an operating system navigation utility, wherein the dialer programhas an associated phone book file, the phone book file not being associatedwith the at least one application program, and wherein the dialer programdetermines activity status of the at least one application program; a TAPIcompliant telephony device (TAPI device) coupled to said computer by a datapath and structured for connection to a telephone line from a telephone serviceprovider, said TAPI device being interfaced with a TAPI compliant driverprogram, said driver program being capable of receiving telephone functioncommands from said programs in said telephone function library and convertingthe telephone function commands to commands and/or signals specific to saidTAPI device and for sending said commands and/or signals to said TAPI device tocause the TAPI device to carry out telephone functions; a keyboard coupled tosaid computer for providing user inputs; a pointing device coupled to saidcomputer for providing user inputs; and a video display coupled to saidcomputer, wherein the dialer program is configured to retrofit a dialerrepresentation on a title bar of a window of the at least one applicationprogram lacking telephony capabilities only when the at least one applicationprogram is active to provide the telephony capabilities to the at least oneapplication program, wherein, when a user selects, via the keyboard or thepointing device, the retrofitted dialer representation, the dialer programaccesses the phone book file to search for a phone number to be dialed by thedialer program, and wherein the searching of the phone book file is based on asearch key, the search key comprising text that is displayed in a window of theat least one application program and highlighted by the user via the keyboardor the pointing device before the user selects the retrofitted dialerrepresentation.

 

2. The apparatus of claim 1 wherein said dialerprogram retrofits the dialer representation so as to always be visible on atitle bar of a window of an active application program.

 

3. The apparatus of claim 2 wherein said dialerprogram retrofits the dialer representation near the title bar of a currentlyactive window of a currently active application program.

 

4. The apparatus of claim 2 wherein said dialerprogram also displays a dialer icon in or near the system tray of a Windows 95operating system driven desktop video display.

 

5. The apparatus of claim 1 wherein said dialerprogram displays one or more drop down menus when a pointing device click onsaid dialer representation is detected, the menu options displayed on said dropdown menus being dependent upon whether the user is or is not currently engagedin a telephone conversation via said TAPI device.

 

6. The apparatus of claim 1 wherein said dialerprogram displays one or more drop down menus when a hot key combination eventis detected comprising pressing a predetermined combination of several keys onsaid keyboard simultaneously, the menu options displayed on said drop downmenus being dependent upon whether the user is or is not currently engaged in atelephone conversation via said TAPI device.

 

7. The apparatus of claim 1 wherein said dialerprogram stores names and telephone numbers in the phone book file stored inmemory or on a hard disk of said computer and displays menu options whichdepend upon one or more of the following factors: whether the user has any textor numbers selected in a window of the current application program; whether theselected text or numbers appear to contain a phone number or not; if not aphone number, whether the selected text matches any stored name in the phonebook file; whether or not the user is or is not currently using said TAPIdevice in an ongoing telephone conversation; and regardless of whether the useris or is not currently engaged in a telephone conversation, whether or not atelephone number has been highlighted in a window of the current applicationprogram.

 

8. The apparatus of claim 7 wherein said dialerprogram further displays menu options which depend upon one or more of thefollowing factors: if the selected text does not contain a phone number anddoes not match a name in said phone book file, whether the selected textappears to be a URL.

 

9. The apparatus of claim 8 wherein anapplication program controlling said computer is a web browser program andwherein said dialer program controls said computer to launch said web browserif the user has selected text in the active window of the active applicationprogram which is a URL and to cause said web browser to open the web pagelocated on the world wide web at the URL which is highlighted.

 

10. The apparatus of claim 1 wherein said dialerprogram displays all available telephony function options in a menu when a hotkey combination is pressed with the available options for the particularcontext displayed in contrasting color to options which are not available.

 

11. The apparatus of claim 1 wherein said dialerprogram displays all available telephony function options in a menu when apointing device click on a dialer icon is detected with the available optionsfor the particular context displayed in contrasting color to options which arenot available.

 

12. The apparatus of claim 1 wherein said dialerprogram displays all available telephony function options in a menu when a hotkey combination is pressed or a pointing device click on a dialer icon isdetected with the available options for the particular context signalled to theuser.

 

13. A method for a computer coupled to atelephony device to implement telephony functions, comprising: executing, on anoperating system platform, a dialer program and at least one applicationprogram that differs from the dialer program, wherein the at least oneapplication program does not comprise a telephone application program or anoperating system navigation utility, and wherein the dialer program has anassociated phone book file, the phone book file not being associated with theat least one application program; by the dialer program, determining activity statusof the at least one application program; by the dialer program, retrofitting adialer representation on a title bar of a window of the at least oneapplication program lacking telephony capabilities only when the at least oneapplication program is active to provide the telephony capabilities to the atleast one application program; by the dialer program, accessing the phone bookfile to search for a phone number to be dialed by the dialer program, theaccessing being triggered when a user selects, via an input device, theretrofitted dialer representation; and by the dialer program, searching thephone book file for the phone number based on a search key, the search keycomprising text that is displayed in a window of the at least one applicationprogram and highlighted by the user via the input device before the userselects the retrofitted dialer representation.

 

14. The method of claim 13, further comprisingdetermining an active program which is currently controlling the computer andadding dial, conference, transfer and hold telephony functions to said activeprogram and wherein said dial, conference, transfer and hold telephonyfunctions can be carried out by a user by invoking selections from a telephonymenu.

 

15. The method of claim 13, further comprisingadding one or more telephony functions to an active application programincluding the ability to determine if a highlighted section of text in theactive window painted by said active program is a phone number or a name and ifthe highlighted text is a name, looking up the phone number for the name in thephone book file and displaying menu options for dial and pop which the user canselect, and, if the dial option is selected, controlling said TAPI device todial the number, and if the pop option is selected, controlling said computerto launch an application process which stores records of people ororganizations which can be searched by name or telephone number and searching afile of people or organizations maintained on said computer using thehighlighted name or phone number and displaying any record which matches thename or number.

 

16. An article, comprising: a storage mediumhaving stored thereon instructions that when executed by a machine result inthe following: executing, on an operating system platform, a dialer program andat least one application program that differs from the dialer program, whereinthe at least one application program does not comprise a telephone applicationprogram or an operating system navigation utility, and wherein the dialerprogram has an associated phone book file, the phone book file not beingassociated with the at least one application program; by the dialer program,determining activity status of the at least one application program; by thedialer program, retrofitting a dialer representation on a title bar of a windowof the at least one application program lacking telephony capabilities onlywhen the at least one application program is active to provide the telephonycapabilities to the at least one application program; by the dialer program,accessing the phone book file to search for a phone number to be dialed by thedialer program, the accessing being triggered when a user selects, via an inputdevice, the retrofitted dialer representation; and by the dialer program,searching the phone book file for the phone number based on a search key, thesearch key comprising text that is displayed in a window of the at least oneapplication program and highlighted by the user via the input device before theuser selects the retrofitted dialer representation.
